Simple Assault
There are 2 types of assault in Georgia- simple assault, which is a misdemeanor, and aggravated assault, which is a felony.
A simple assault occurs when you:
- Attempt to commit a violent injury to another
- Commit an act that places another in apprehension of receiving violent injury.
An aggravated assault occurs when you assault someone:
- With intent to murder, rape, or rob
- With a deadly weapon
- Fire at persons from a moving vehicle.
The threshold dollar amount between a felony theft charge and a misdemeanor theft charge is $500 (except for shoplifting, where the threshold amount is $300).
