Simple Assault

There are 2 types of assault in Georgia- simple assault, which is a misdemeanor, and aggravated assault, which is a felony.

A simple assault occurs when you:

  • Attempt to commit a violent injury to another
  • Commit an act that places another in apprehension of receiving violent injury.

An aggravated assault occurs when you assault someone:

  • With intent to murder, rape, or rob
  • With a deadly weapon
  • Fire at persons from a moving vehicle.

The threshold dollar amount between a felony theft charge and a misdemeanor theft charge is $500 (except for shoplifting, where the threshold amount is $300).

If you have been charged with any type of theft-related crime, you should hire an experienced criminal defense attorney to ensure that your case is dismissed, the charges lessened, or an alternative sentence is attained.
